Delivery driver raped unconscious woman in her own bed after they met at pizza restaurant

An Albanian delivery driver who raped an unconscious woman in her own bed after they met in a pizzeria has been sentenced to seven years in prison.

Klodjan Samurri, 29, attacked the woman after hitting her during a night out in north London in June last year.

The victim told the Old Bailey that she went to bed and woke up to find Samurri having sex with her.

The woman was out with a group of friends in Holloway on June 26, 2021 when she met Samurri.

‘They ate, they went between 11 and 12,’ prosecutor Katrina Charles previously told the court.

‘They went home and passed another Italian restaurant that two of the girls knew as they regularly order pizza from this restaurant.

‘The owner recognized her in passing and was friendly. He introduced her to three other men, one of whom was Samurri.

‘There was space outside, it’s June so they sat outside and talked and had another drink, a cigarette, they were all friendly,’ Ms Charles said.

‘They talked about moving on and continuing the party and agreed to return to one of their apartments.

Ms Charles claims the men were made clear that “they were invited to come over, they couldn’t stay the night”.

‘At some point they would have to go. Boundaries were set,’ she said.

‘At this point in the night, the victim felt “extra drunk” and “just wanted to go home.

The prosecutor claimed the other two girls were “linking up” with two of the men, but that Samurri was “actually a third wheel” because the applicant wanted to go home.

Ms Charles told the court: ‘When they returned to the flat the applicant went to bed. She put on her eye mask, the lights went out and she was out for the count. Her friends remember her words were slurred.

‘One of the women saw Samurri go into the victim’s room and asked if she was okay.

‘She told him not to go into her friend’s bedroom because she was sleeping. It was made clear to him that he should not enter this bedroom with the lights off and a woman sleeping in it,’ the prosecutor said.

One of the women later noticed that the victim’s bedroom light was on.

Ms Charles said: ‘She opened the door, walked in and saw the accused getting off the complainant’s bed. He was clothed, but he buttoned his jeans.

‘She could see that the complainant was not wearing a top. She was wearing pajamas when she came in earlier.

‘The victim told the Old Bailey (pictured) that she went to bed and woke up to find Samurri having sex with her. Samurri denied two rape allegations but was convicted of one. He was sentenced to seven years in prison and is subject to mandatory reporting for sex offenses.

The woman asked her friend if she was okay and asked Samurri if he had permission to have sex with her and he replied, ‘Yes, yes, all right.’

Then he led her out of the bedroom. Thirty minutes later, two of the women went back to check and saw him buttoning his jeans again.

‘It was clear that the complainant was completely upset. They asked her if she wanted to have sex with the accused and she managed to tell them she had repeatedly asked him to leave,’ Ms Charles said.

‘The defendant insisted that the sexual intercourse was consensual.

‘She doesn’t remember the defendant entering her room, there came a point where she woke up when he was having intercourse with her.

‘She kept drifting into consciousness and was slow to respond, but remembers telling him to stop and get off her.

‘She also remembers him behind her attempting to have intercourse before she managed to push him away from her and then said no.

‘He wrapped her arms around her when he had sex with her, which made her feel constrained.

The judge, Mr Recorder Bernard Richmond, KC, told Samurri: ‘You attacked a woman in her own bed… caused her to leave her home and this was an invasion of her privacy in every way.

‘Perhaps you will ponder what caused you to behave in this appalling way, but what you did was harmful, disgusting and appalling, and any sane member of this community would agree.’

Samurri denied two rape allegations but was convicted of one. He was sentenced to seven years in prison and is subject to mandatory reporting for sex offenses.
